1) On February 7, 1988, a Delaware State Police Trooper observed Eugene Emmell traveling approximately 20 m.p.h. over the speed limit (going 60 m.p.h. in a 40 m.p.h. zone). He failed to use a turn signal when switching lanes and, after stopping at an intersection, allowed his car to protrude into the oncoming lane of traffic. The trooper stopped Emmell and Emmell exited his car and admitted to the trooper that he had been drinking. According to the trooper, Emmell failed several field sobriety tests. At approximately 1:40 a.m. Emmell was taken to troop 6 where he failed additional sobriety tests. Intoxilizer results revealed a blood alcohol level of .13.
