Description
This is an appeal from a constructive trust imposed on insurance proceeds by the probate court. The probate court ruled that appellees deceased husband violated a temporary injunction entered by the district court forbidding any change in the beneficiary on a term life insurance policy. After the injunction was entered, the decedent changed the named beneficiary from appellee, Kay Oak, to appellant, Eugene Oak. In two points of error, appellant, the decedents brother, argues that the probate court erred in: (1) imposing a constructive trust on the proceeds because the district courts order was void; and (2) ruling that there was a valid and operative change of beneficiary by the decedent as a matter of law. We affirm.
