Action commenced by plaintiff Eugene N. Jaster against defendants Carlet Miller and Rural Mutual Casualty Insurance Company, his insurer; Martin Kujak, Frank Kujak, Emil J. Kujak and Hubert I. Hujak, doing business a Walske Transfer (hereafter called Walske Transfer), and Chicago Ice Producers Mutual Liability Company, their insurer; Moore Motor Freight Lines and its insurer, Bruce Dodson, attorney in fact for subscribers at Casualty Reciprocal Exchange. The action arose out of a collision between an automobile driven by Carlet Miller and a truck driven by Martin Kujak, in which Jaster was a passenger. At the time of the accident the truck was leased by Moore Motor Freight Lines from Walske Transfer and was being operated by Martin Kujak in the business of Moore Motor Freight. A cross-complaint was filed by Moore Motor Freight and Bruce Dodson against Walske Transfer and the Chicago Ice Producers Mutual Liability Company for any damages which might be incurred by Moore and Dodson in the event the negligence of Martin Kujak should be established. A plea in abatement by Chicago Ice Producers was sustained. During the trial Rural Mutual Casualty Company and Bruce Dodson settled the claim of Eugene Jaster and the trial proceeded with Carlet Miller taking the position of plaintiff.
